Official Rules

ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR REDEEM PRIZE. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. The “Best Seats in the Nest” Sweepstakes (the “Sweepstakes”) is offered only in Arizona, and is open only to legal residents of Arizona age 21 or older. Void where prohibited. The following persons are not eligible to participate: Employees, contractors, directors, and officers of Arizona Cardinals Football Club LLC; New Cardinals Stadium, LLC and American Furniture Warehouse, and their respective affiliates, or any company involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, “Promotion Parties”) and their respective immediate family members. “Immediate family members” means spouses, parents/guardians and children.

SPONSOR AND ADMINISTRATOR: American Furniture Warehouse is the Sponsor and the Administrator of the Sweepstakes.

TIMING: Sweepstakes begins at 12:01 AM Arizona Time (“AZT”), July 17, 2017 and the sweepstakes entry period ends at 11:59 PM AZT on December 27, 2017 (the “Drawing Deadline”). The period commencing at the Start Time and ending at the Drawing Deadline is referred to herein as the “Sweepstakes Period.” The Administrator’s computer is the official timekeeping device for the Sweepstakes.

PRIZES: Ten (10) first place prize winners will receive the following: Two (2) lower level tickets to a Cardinals home game, one (1) parking pass, two (2) pre-game field passes, two (2) Cardinals replica jerseys, two (2) Cardinals hats, and two (2) stadium concession gift cards. Approximate retail value of prize: $600. 

Winner is solely responsible for all expenses not specified in these Official Rules including but not limited to meals, incidentals, tips, or other personal expenses. Winner will be issued a 1099 federal tax form. All prizes are expressly limited to the items listed above and do not include any other accessories, services or expenses. Taxes (if any) are the responsibility of the prizewinner. Sponsor reserves the right to substitute a prize of equal or greater value at Sponsor’s sole discretion.

HOW TO ENTER: During the applicable Sweepstakes Period, hand print your name, your complete street address, and daytime phone number and e-mail address (if available) on an Official Entry Form (available while supplies last in participating American Furniture Warehouse stores located in the State of Arizona) or on a 3” x 5” index card or piece of paper and mail it to: Arizona Cardinals, Attn: “Best Seats in the Nest” Sweepstakes, P.O. Box 888, Phoenix, AZ, 85001-0888.

Entries must be postmarked by the Drawing Deadline and received no later than 5:00 PM AZT on the third day after the Drawing Deadline. Limit one entry per person during the entire Sweepstakes Period. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different identities or any other method will void that person’s entries and that participant may be disqualified. Entries must be handwritten and may not be photocopied, printed by machine, computer printed or otherwise mechanically reproduced. The Promotion Parties are not responsible for lost, interrupted or unavailable Official Entry Forms whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information regardless of cause. Once submitted, entries become the exclusive property of Arizona Cardinals Football Club and will not be acknowledged or returned.

GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fire, flood, earthquake, epidemic, explosion, labor dispute or strike, act of public enemy, equipment failure, riot or civil disturbance, war or other military action, terrorist threat or activity, government order, fraud, technical failures or any other factor beyond Sponsor’s reasonable control (including any labor dispute affecting the National Football League) impairs the integrity, feasibility or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

In the event that this Sweepstakes is challenged by a legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Sweepstakes, or to disqualify entrants residing in the affected geographic areas. In such an event, the Promotion Parties shall have no such liability to any entrants who are disqualified due to such action.

LIMITATION OF LIABILITY: By participating in the Sweepstakes, entrants release the Promotion Parties and their respective officers, directors, employees, agents and affiliates from any and all claims, damages or liabilities arising from or relating to such entrant's participation in the Sweepstakes. By accepting a prize, (a) entrant agrees that the Promotion Parties will have no liability whatsoever for, and shall be held harmless against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes; from acceptance, possession, misuse or use of any prize and (b) entrant grants (and agrees to confirm grant in writing promptly upon request) to the Promotion Parties, Sponsor and those acting under Sponsor’s authority, the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information, at any time or times, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the World Wide Web without review, notification or approval, and additional compensation, unless prohibited by law. Sponsor is not liable in the event that any portion of the Sweepstakes or prize is canceled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a “Force Majeure Event”).

DRAWINGS: One (1) random drawing will be conducted each week of a Cardinals home game during the 2017 NFL season. Drawings will occur Monday before each game, at 10:00 AM AZT. At each drawing, one (1) winner will be selected via a random drawing from all eligible entries received during the Sweepstakes Period. An additional random drawing for a runner-up will be conducted each week during the 2017 NFL season. At each of these drawings one (1) winner will be selected via a random drawing from eligible entries received during the Sweepstakes Period. The random drawing will be conducted by the Administrator, whose decisions will be final, binding and conclusive in all matters relating to the Sweepstakes. The drawing will be conducted at a location to be determined by the Administrator.

ODDS OF WINNING: The odds of winning depend on the number of eligible entries received.

MISCELLANEOUS: Potential winners will be notified by phone and/or mail at the phone number/address indicated on their entry form. The potential winner will be notified by phone and will be required to respond to the phone call within 48 hours indicating whether he/she can accept the prize. If no return call is received within the time allotted, an alternate winner will be selected. Any alternate winners selected will also be required to respond to the phone call within 48 hours. Winners will be required to complete, sign and return an Affidavit of Eligibility/Liability Release and, where lawful, Publicity Release within five (5) days of prize notification. Winners' guests may also be required to complete and sign a Liability Release within the same time frame. If a guest is a minor, the Liability Release must be completed by the minor guest’s parent or legal guardian and minor guest must attend the event with his/her parent or legal guardian. If attempted notification is returned as undeliverable, if any required documents are not returned within the required number of days, if winner cannot be verified, or if winner is otherwise unable to accept the prize as stated, prize will be forfeited and may be awarded to an alternate winner. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Road Games are subject to availability. Children attending the Road Game must be accompanied at the Road Game at all times by a parent or legal guardian. Seating assignments at the Road Game are at the sole discretion of the Sponsor. Transportation (other than Air Transportation), meals, beverages, gratuities, and all other expenses not specified herein are winner’s responsibility. Winner must accept prize as stated, or prize will be forfeited and awarded to an alternate winner. No prize transfer. No prize substitution or cash equivalent of prize except at sole discretion of Sponsor for a prize of equal value, due to unavailability of prize for any reason. All Federal, State, local taxes, and insurance on prize are solely the responsibility of the winner. An IRS Form 1099 reflecting the value of the prize will be issued to the winner.

DISPUTES: Except where prohibited, entrant agrees that (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively in accordance with the laws of the State of Arizona, without regard to its choice of law rules and entrant consents to the jurisdiction and venue of the federal, state and local courts located in Maricopa County, Arizona; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney’s fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules (whether of the State of Arizona or any other jurisdiction) which would cause the application of the laws of any other jurisdiction.

RESULTS: For the names of the winners, send a hand-printed, self-addressed stamped envelope to “Best Seats in the Nest” Winners List, P.O. Box 888, Phoenix, AZ, 85001-0888. Requests for a winners list must be received no later than January 31, 2018.

The National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Properties LLC, NFL Enterprises LLC, NFL Productions LLC and NFL International LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees (collectively, the “NFL Entities”) will have no liability or responsibility for any claim arising in connection with participation in this promotion or any prize awarded.
